Terms of Service

These terms are an agreement between you and Jad Ayman Saleh Abdalla ("we", "us") for your use of the Size Up app. By using Size Up, you accept them. Please read our Privacy Policy too, which explains how we handle your information.

1. Size Up is not medical advice

Size Up provides general nutrition information and estimates to support gaining weight and building muscle. It isn't a medical device, and it doesn't provide medical, dietetic or clinical advice.

Talk to a doctor or registered dietitian before making significant changes to how you eat, especially if you:

• have a medical condition, such as diabetes or heart, kidney or liver disease;
• are pregnant or breastfeeding;
• have, or have had, an eating disorder;
• are under 18.

If you feel unwell, stop following the app's suggestions and get medical help.

2. AI estimates can be wrong

Calorie and macro figures, food recognition from photos, and meal suggestions are generated by AI. They are automated estimates and may be incomplete or inaccurate, especially from photos, where portion sizes are hard to judge. Use your own judgment, and don't rely on Size Up where accuracy is critical.

Allergies and intolerances: Size Up doesn't track allergies or intolerances. Suggestions and scan results may contain allergens, even when they aren't listed. Always check ingredients yourself. Diet preferences, such as vegan or vegetarian, are applied on a best-effort basis and aren't guaranteed.

3. Who can use Size Up

You must be at least 16 years old to use Size Up. If you're 16 or 17, you need permission from a parent or guardian, who agrees to these terms on your behalf.

4. Your account

Please give accurate information, keep your password secure, and keep your account to yourself. You're responsible for what happens under your account. If you think someone else has accessed it, tell us at support@sizeupapp.com.

5. Free use and subscriptions

• Size Up includes a limited number of free AI requests. After that, AI features need a subscription. We may change the free allowance.
• Subscriptions are purchased through the Apple App Store and charged to your Apple ID account.
• Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription in your Apple ID account settings. Cancelling stops future renewals, and you keep access until the end of the period you've paid for.
• Deleting the app or your Size Up account doesn't cancel your subscription. Cancel it in your Apple ID settings.
• Refunds are handled by Apple under Apple's policies. We can't issue refunds directly.
• Prices are shown in the app before you buy and may vary by country. If a price changes, you'll be told in line with Apple's rules.
• To prevent abuse, subscriptions include a generous daily limit on AI requests.

6. Acceptable use

When using Size Up, you agree not to:

• copy, modify or reverse engineer the app, except where the law allows it;
• access the service by automated means, or scrape it;
• get around usage limits, security measures or payment;
• interfere with the service, or try to access other users' data;
• upload content that is illegal, offensive, or that you don't have the right to share;
• resell or commercially exploit access to Size Up;
• use Size Up for anything unlawful.

7. Your content

You own the information and photos you add to Size Up. You give us a limited permission to store, process and transmit them only so we can run the app for you, including sending them to our AI provider as described in our Privacy Policy. That permission ends when you delete the content, apart from copies that remain in backups for a limited period.

8. Our app

Size Up, including its design, code, name and branding, belongs to us. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial use, under these terms.

9. Changes to the app and these terms

We may add, change or remove features, and we don't guarantee the service will always be available or free of errors. We may also update these terms. We'll change the date at the top, and if a change is significant we'll tell you in the app before it takes effect. If you keep using Size Up after that, you accept the updated terms.

10. Ending your use

You can stop using Size Up at any time, and delete your account in Settings → Delete account. We may suspend or close an account that breaks these terms or abuses the service, and where it's reasonable we'll tell you first. Sections that by their nature should continue, such as disclaimers and limits on liability, still apply after your use ends.

11. Disclaimers

To the extent the law allows, Size Up is provided "as is" and "as available". We don't promise that estimates will be accurate or that you'll reach any particular result. Your results depend on many things outside the app, including your training, sleep, genetics and consistency.

12. Limits on our liability

To the extent the law allows, we aren't liable for any indirect, incidental, special or consequential loss, for inaccuracies in calorie counts, nutrition estimates or food identification, or for health outcomes that result from relying on estimates or suggestions in the app. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits any liability that can't legally be limited, including for death or personal injury caused by negligence, or for fraud. These terms don't affect any rights you have as a consumer under the law of the country where you live.

13. Governing law

These terms are governed by the laws of the Hashemite Kingdom of Jordan, and disputes will be handled by the courts of Jordan. If you live elsewhere and the consumer protection laws of your country give you more protection, those laws still apply to you.

14. Apple App Store terms

If you downloaded Size Up from the Apple App Store:

• These terms are between you and us, not Apple. Apple isn't responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you can notify Apple, and Apple may refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple isn't responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and consumer protection claims.
• Apple isn't responsible for investigating, defending or settling any claim that the app infringes someone else's intellectual property.
• You must comply with any applicable third-party terms, such as your mobile data agreement, when using the app.
• You confirm that you aren't located in a country subject to a US government embargo, and that you aren't on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
